Do I Need a Nassau County Contested Divorce Lawyer?

Divorce can be a very complex issue, especially when both spouses are unable to agree on the terms of their divorce. If you are currently going through the contested divorce process, you must retain the services of a knowledgeable Nassau County divorce attorney who can fight for your best interests and protect what is rightfully yours.

The Contested Divorce Process in New York State

When a couple in New York gets divorced, one spouse will first file a Complaint for Divorce and serve their spouse with the Complaint. From here, the spouse who received the Complaint will have to respond within 20 days if they are served in NYS, or 30 days if they are served in a different state. From here, the divorcing couple and their attorneys will attend a preliminary conference, wherein all divorce-related issues will be established (e.g. child support/alimony terms, child custody terms, and property distribution).

If the spouses cannot agree on even one of those critical divorce terms, they are in what is considered a contested divorce. When divorce proceedings take place, the court will focus on settling all contested issues.

The spouses will then have to attend a compliance conference, wherein the judge will attempt to get them to settle on a divorce agreement. However, if the divorce cannot be settled at this point, the divorce will go to trial. At the trial, the judge will hear both spouses’ wants and needs regarding their divorce agreement, analyze various documents, such as bank statements, and ultimately settle the divorce.

If child custody is an issue, the judge will also have to determine the child’s best interests and, from there, determine a custody agreement. You can rely on a Nassau County Contested Divorce Lawyer right here at Barrows Levy PLLC today to effectively handle your case.
